TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of shopsifton.ca (the “Site”) and purchases made from Sifton. Sifton is operated by Benjamin Maczka. In these Terms, “Sifton,” “we,” “us,” and “our” refer to Sifton and its operator.

By using the Site or placing an order, you agree to these Terms and the policies referenced below. Nothing in these Terms excludes, restricts, or replaces any right or remedy that cannot legally be waived, including rights under Québec’s Consumer Protection Act and the Civil Code of Québec.

  1. ELIGIBILITY AND PERMITTED USE

You must have the legal capacity to enter into a contract, or have authorization from a parent or legal guardian, to place an order.

You may use the Site only for lawful purposes. You must not interfere with its operation, introduce malicious code, attempt unauthorized access, misuse another person’s information, or use the Site in violation of applicable law.

  1. PRODUCTS AND AVAILABILITY

We make reasonable efforts to describe and display our products accurately, including their features, colours, sizing, materials, and prices. Screen settings and photography may affect how colours appear.

Product descriptions, images, sizing information, and availability may be corrected or updated when necessary. Products and variants are available while supplies last.

We may reasonably limit quantities to prevent fraud, resale abuse, or inventory errors, subject to applicable law.

  1. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the selected products. A purchase contract is formed when Sifton accepts the order and sends an order confirmation, subject to mandatory applicable law.

We may refuse or cancel an order where reasonably necessary, including because of unavailable inventory, an obvious pricing or description error, suspected fraud, payment authorization failure, or a legal restriction. If we cancel an order after payment has been processed, we will refund the amount charged to the original payment method.

Please review your products, quantities, shipping address, and contact information before submitting your order. If you notice an error afterward, contact us promptly. We will try to help, but changes cannot be guaranteed after processing or shipment.

  1. PRICES, TAXES, AND PAYMENT

Unless stated otherwise, prices are displayed in Canadian dollars. Applicable taxes, shipping charges, discounts, and the total amount payable are shown before checkout is completed.

Available payment methods are displayed at checkout and are processed through Shopify or other authorized payment providers.

We may change prices for future orders without notice. A price change will not affect an order that we have already accepted, except where permitted or required by law.

  1. SHIPPING AND DELIVERY

Sifton currently ships within Canada.

Processing times, shipping rates, free-shipping eligibility, delivery estimates, address changes, and delayed or missing packages are described in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates unless expressly stated otherwise. Nothing in this section limits any cancellation, refund, or delivery right provided under applicable consumer law.

  1. RETURNS, EXCHANGES, AND REFUNDS

Our voluntary 14-day return program, free eligible returns within Canada, exchanges subject to available inventory, final-sale conditions, and refund timing are described in our Return and Refund Policy, which forms part of these Terms.

That policy does not limit any legal warranty or other mandatory consumer right.

  1. LEGAL WARRANTIES AND CONSUMER RIGHTS

Products sold by Sifton are covered by the legal warranties that apply under Québec and Canadian law, including warranties of normal use, reasonable durability, conformity with the product description, and freedom from hidden defects where applicable. These warranties apply automatically and without additional charge.

No provision of these Terms—including a final-sale condition or limitation of liability—limits a remedy that a consumer is legally entitled to claim.

  1. INTELLECTUAL PROPERTY

The Site and its content, including Sifton’s name, logos, artwork, product designs, photographs, graphics, text, and layout, are owned by or licensed to Sifton and protected by applicable intellectual-property laws.

You may view the Site and make copies reasonably necessary for personal shopping. You may not reproduce, distribute, modify, sell, or commercially exploit Site content without prior written permission, except where permitted by law.

  1. THIRD-PARTY SERVICES AND LINKS

The Site is hosted by Shopify and may use third-party services for payments, shipping, analytics, marketing, or other functions. These parties may have their own terms and privacy practices.

Links to third-party websites are provided for convenience. Sifton does not control those websites and is not responsible for their content or practices, except where responsibility cannot legally be excluded.

  1. PRIVACY

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

Payment information may also be processed by Shopify and the payment provider selected at checkout under their respective privacy terms.

  1. SITE AVAILABILITY AND LIMITATION OF LIABILITY

We aim to keep the Site accurate, secure, and available, but interruptions, maintenance, technical errors, or events outside our reasonable control may occur.

To the fullest extent permitted by law, Sifton is not liable for indirect or consequential losses arising solely from the use or unavailability of the Site.

Nothing in these Terms excludes or limits liability for intentional or gross fault, bodily or moral injury, a defective product where liability cannot be excluded, or any consumer right or remedy that applicable law does not permit us to exclude or limit.

  1. SUSPENSION OR TERMINATION

We may restrict access to the Site when reasonably necessary to protect customers, Sifton, or the Site; prevent fraud or unlawful activity; or respond to a security or technical threat.

A suspension or termination does not affect rights and obligations arising from an order already accepted, except where permitted by law.

  1. GOVERNING LAW

These Terms are governed by the laws of Québec and the federal laws of Canada applicable in Québec.

Any dispute will be handled by a court or tribunal with lawful jurisdiction in Québec. This provision does not deprive a consumer of any mandatory protection, venue, or remedy available under applicable law.

  1. CHANGES TO THESE TERMS

We may update these Terms for future use of the Site and future purchases. The revised version will be posted on the Site with a new “Last updated” date.

Changes do not retroactively alter an order already accepted unless the customer agrees or applicable law permits or requires the change.

  1. GENERAL PROVISIONS

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A failure to enforce a provision is not a waiver of that provision. These Terms, the policies incorporated by reference, and the information presented at checkout form the agreement governing use of the Site and purchases from Sifton.
